This Responsible Use Policy (“RUP”) supplements the Rally.Fan Terms of Service, or any other agreement or order form between Metacommerce Inc. d/b/a Rally.Fan (“Rally.Fan,” “we,” “our,” or “us”) and you, being any Customer or User thereof (“you”), governing the use of Rally.Fan’s platform, website, generated output, or other products and services (collectively, the “Agreement”).
This RUP applies to your access and use of the Rally.Fan platform, including Customer Data (such as the Input Data you provide to the platform) and the Generated Output created on its basis, whether used inside the platform or externally. Capitalized terms not defined here have the meanings set forth in the Agreement.
Prohibited Uses
You may not use Rally.Fan, or the content you generate with it, in any way that:
- Violates any law or regulation — including national, federal, state, local, or international law.
- Creates or distributes spam — including bulk unsolicited messages, in violation of the CAN-SPAM Act or similar regulations.
- Exploits or harms minors — including any attempt to target, endanger, or exploit children.
- Contains adult content — including pornographic, sexually explicit, or otherwise inappropriate material.
- Spreads false or misleading information — particularly in areas related to health, medicine, safety, or science.
- Misuses personal data — by generating or sharing personally identifiable information in ways that could cause harm.
- Conceals machine-generated content — by publishing AI-generated text, images, or media without a clear and understandable disclosure.
- Harasses or harms others — including defamation, bullying, threats, or encouraging self-harm.
- Impersonates others without consent — including the creation or use of deepfakes.
- Automates harmful decisions — such as legal or financial determinations that negatively impact an individual’s rights or obligations.
- Promotes hate or discrimination — based on race, ethnicity, gender, sexual orientation, religion, or any other protected category.
- Exploits vulnerable groups — including attempts to manipulate behavior in ways likely to cause harm.
- Engages in political lobbying or campaigns — to influence legislation, regulation, or government decisions.
- Provides unqualified professional services — including medical, legal, financial, or regulated advice without the required licenses.
- Misuses generated content in legal or enforcement contexts — such as predicting criminal behavior or immigration outcomes.
- Violates intellectual property rights — including unauthorized use of patents, trademarks, copyrights, or trade secrets.
- Introduces malicious code — including viruses, worms, trojans, spyware, or any harmful software.
- Circumvents Rally.Fan’s safeguards — including attempts to disable, bypass, or exploit security and compliance measures.
Enforcement
- Rally.Fan reserves the right to determine, in its sole discretion, whether a violation of this RUP has occurred and the severity of such violation.
- Rally.Fan may remove or restrict access to any content, data, or output that violates this RUP, and may suspend or terminate access to the platform for repeat or severe violations.
- You must stop using, and if applicable remove, any content that violates this RUP immediately upon notice.
- If you become aware that the platform has generated or been used to generate content violating this RUP, you must notify us promptly in writing.
